Charges against mini-dress women dropped

All criminal charges have been dropped against the two Dutch women arrested and charged with "ambush marketing" for wearing branded orange minidresses to a soccer match.

Barbara Castelein and Mirthe Nieuwpoort appeared in the Johannesburg Magistrate's Court's dedicated World Cup court on Tuesday morning.

They were part of a group of 36 women who attended the match between Denmark and the Netherlands at Soccer City last week on Monday.

All of them wore bright orange dresses designed as a giveaway by Bavaria.

Castelein and Nieuwpoort were arrested at their hotel in Roodepoort last Wednesday on charges of contravening South Africa's Merchandise Marks Act of 1941 and two sections of the Special Measures Regulations.

On Monday morning, following discussions between the legal team hired for the two women by Bavaria and the prosecution, the women made their second brief court appearance before quickly being released.

Prosecutor Advocate Deborah Zinn told the court that the State had decided to withdraw all charges against the accused.

The two women appeared ecstatic and kissed one another joyfully.

Supporters outside the courtroom presented each of them with a bunch of orange and yellow roses and their passports were handed back to them.

National Prosecuting Authority spokesman Mthunzi Mhaga said the decision was taken after the "accused made representations to the acting director of public prosecutions for South Gauteng".

He said Fifa had also indicated that they were not interested in pursuing the matter further as they had reached a satisfactory settlement with Bavaria.

The terms of this agreement, he said, were to remain private.

"Hence we have decided not to proceed and will maintain the confidentiality aspects at all costs," Mhaga said, adding that the NPA had not been party to the settlement deal.

Both women left the court quickly and declined to speak to the media.
