Gruesome details have emerged during a rape trial against a Ceres man, who said he “felt like it” when asked why he raped a minor boy.
Leano Vergotine, 41, is facing 18 counts, including assault with the intent to do grievous bodily harm, assault, attempted rape, kidnapping, rape, using children for child pornography, creation of child pornography, and the possession of child pornography.
He returned to the Wynberg Magistrate's Court on Tuesday for the defence to call a witness, but they did not come to court.
The State alleges that the accused kidnapped a 16-year-old girl on September 10, 2022 and threatened her to consent to sexual penetration while taking photographs of her private parts.
Court documents read: “The accused unlawfully and intentionally committed an act of sexual penetration with the complainant by penetrating her anus with his penis without the consent of the said complainant.”
The following day, the accused raped a 15-year-old minor boy by penetrating him without consent while taking a video.
The court heard that video evidence of the said videos were viewed by the judge, State, defence, and the investigating officer.
Court documents further revealed the gory details of what transpired.
It stated: “The accused then tells the complainant that should he take [the accused] for a “p**s”, he will make sure the entire school sees it.
“The video then focuses on the accused’s and complainant’s face while the accused continues doing up and down movements on top of the complainant.
Vergotine is also charged with sexually grooming and the rape of a a nine-year-old boy and offering a 12-year-old boy money and gifts in exchange for pictures of his private parts.
State Prosecutor Renee Uys cross-examined the accused on Monday on why he raped the 15-year-old minor, to which he said: “I felt like it. I couldn’t control myself.”
He further stated that the sexual penetration of the 16-year-old girl was consensual vaginal penetration and denied anally penetrating her.
The court heard that the reason he assaulted her was that “she was drunk”, and the following morning, she could not remember.
Uys probed the accused if he regularly has sex with people who are too drunk to consent, to which he replied: “Is nie soe nie.” (it is not like that)
The case was postponed to April 22.
