Justice served: Worcester court sentences man to life for horrific assaults

Gerald Joseph has been sentenced to life imprisonment by the Worcester Regional Court for rape, assault and kidnapping following two violent attacks on his former partner.

The Worcester Regional Court has sentenced a 31-year-old man to effective life imprisonment for rape, alongside additional prison terms for assault and kidnapping.

Gerald Joseph was convicted on three counts of assault with intent to cause grievous bodily harm, one count of kidnapping and one count of rape. He was sentenced to 10 years’ direct imprisonment on each assault count, five years for kidnapping and life imprisonment for rape, resulting in a combined sentence of life plus 35 years.

The court ordered that his name be entered into the National Register for Sex Offenders, that the victim be notified of any parole proceedings, and declared him unfit to possess a firearm.

According to Eric Ntabazalila, the accused and the 25-year-old victim had previously been in a relationship.

“In the first incident, on April 23, 2023, at Sterkwater Farm in Prince Alfred Hamlet, the accused attacked the victim while she was socialising with friends, stabbing her on the arm and back without provocation,” Ntabazalila said.

“She sustained three stab wounds and was taken to hospital. No arrest was made at the time.”

He said a second incident took place on June 25, 2023.

“The accused fetched the victim from a friend’s house and, on the way, they argued. He punched her in the eye and, on arrival at his house, hit her on the head with a brick and on the back with a chair before forcing her into the house and raping her,” Ntabazalila said.

“The victim’s aunt, who witnessed the attack, called the police and accompanied them to the house, where the victim was found half-naked.”

Joseph was arrested but released the following day. The victim later opened a case, after which he was re-arrested.

Joseph pleaded not guilty, claiming self-defence. The State relied on testimony from the victim and her aunt, supported by medical evidence and reports presented during sentencing.

Regional court prosecutor Chantal de Vos argued that Joseph exploited the prior relationship and subjected the victim to repeated violence. The court found no substantial and compelling circumstances to deviate from prescribed minimum sentences and imposed life imprisonment.
