A farm worker, Willem Olivier, 52, along with accomplices Kelvin Vlok, 24, and a 20-year-old minor, has been sentenced to 42 years in prison for robbing and murdering their employer at a farm in Ceres.
Willem Olivier, 52, Kelvin Vlok, 24, and their 20-year-old accused, who was a minor at the time entered a plea and sentencing agreement with the State in the Worcester Regional Court, Western Cape.
The 20-year-old cannot be named as he was a minor at the time of the crime and has been sentenced under the Child Justice Act.
The trio was charged with robbery with aggravating circumstances, illegal possession of a firearm, illegal possession of ammunition, and the murder of 77-year-old Christina Walters at her home on Papkuil Farm.
Evidence before the court revealed that on March 4, 2023, Olivier requested Vlok and the minor to accompany him to the farm to resolve a wage dispute between him and his employer, Walters.
Upon arrival at the farm, Olivier asked Walters for two cigarettes, and on her return from fetching the cigarettes, she was accosted.
The three grabbed Walters, dragged her outside the house, tied her with a belt and barbed wire around her hands and neck. The three then repeatedly kicked her all over her body while she was lying on the ground.
Olivier then instructed Vlok to head into the house and take the valuable items while he and the minor remained outside keeping watch over Walters, who was in extreme pain.
Vlok returned with groceries, alcohol, a cellphone and four firearms and ammunition.
It was further revealed that the trio took a firearm and each took turns shooting Walters, who was still on the ground.
They fled on foot with the loot and firearms. They made their way to Olivier’s house on Klein Papkuil Farm. The court heard that Vlok and the minor then got onto a donkey cart and travelled to a field where they hid the firearms and ammunition.
Information followed up by the police led to the arrest of the trio, who cooperated and pointed out the firearms. It was the minor who confessed to the crimes they committed.
The court sentenced Olivier and Vlok to 12 years direct imprisonment for robbery with aggravating circumstances, 30 years direct imprisonment for murder, 10 years direct imprisonment for illegal possession of a firearm and 10 years direct imprisonment for illegal possession of ammunition. It ordered the sentences it imposed for illegal possession of a firearm and illegal possession of ammunition to run concurrently with the sentence it imposed for the murder charge.
The court sentenced the 20-year-old under Section 71 of the Child Justice Act, 75 of 2008, to 10 years for robbery with aggravating circumstances and 20 years for murder, with five years suspended on the condition he does not commit a violent offence during that time. He also received five years for illegal possession of a firearm and five years for illegal possession of ammunition. The court ordered these sentences to run concurrently with the murder sentence.
The Director of Public Prosecutions in the Western Cape, Advocate Nicolette Bell, applauded prosecutor and investigating officer, remarking that such violent criminals who do not respect the sanctity of life, who mercilessly attacked an elderly woman in her home, brutally kicked her while lying helplessly on the ground and took turns shooting at her, do not turn angels overnight and realised their wrongs.
“They plead guilty due to the strength of the evidence against them and realised they have no other option. The attack on the elderly woman can never be accepted and can never be justified. We hope her family finds solace knowing that perpetrators of the heinous crimes will spend a long time in prison,” Bell said.
