Rosie Motene sues ‘Podcast and Chill’ and Tol Ass Mo for defamation

Veteran actress Rosie Motene is taking “Podcast and Chill” content producer, Duduzie Methula, co-hosts, MacG and Sol Phenduka, and comedian Tol Ass Mo, to the cleaners.

According to court documents, which are in possession of Independent Media Lifestyle and were filed on March 8, 2023, the former “Generations” actress is suing them for R200 000 for allegedly defaming her.

The lawsuit comes after the award-winning comedian appeared on episode 416 of “Podcast and Chill” on December 8, 2022, where he slammed Motene for “coaching” model and actress Lerato Moloi “on how to nail” Mo for rape.

During the podcast, Mo ranted, “The biggest b**ch to attack me. Biggest number one feminist fucking b**ch, Rosie Motene. Hmm. Ask any ni**a. Ask any ni**a will tell you. Koo beans ... Gwana Satan (Satan’s child) ... Kai Motene’s younger sister ...

“She (Rosie Motene) was busy coaching Lerato. Tell them he raped you. Tell them! Tell them, tell them you want your day in court.

“She put pressure on the NPA. The NPA can see you. No, we can't prosecute this guy. Here's everything. Here's the alibi. Here's everything that shows that this man is innocent. There's nothing we can prosecute this guy on.

“She put pressure. Pressure NPA. Now they here July because of what? Social media. Hey, she deserves her day in court ... There's an article that comes out. Top top five woman believers of Lerato, Rosie Motene…”

The YouTube podcast has been viewed by over 1.7 million people to date.

According to the court documents, the descriptors of “koo beans” and “Satan’s child” in the statements were “derogatory, wrongful, defamatory and injurious to the dignity” of Motene.

In addition to the R220k, Motene wants an apology in the form of a video from Mo, which must be posted on his X (formerly Twitter) page and his Instagram feed for a period of 30 days.

She further asked for an apology video from MacG and Phenduka to be broadcast on “Podcast and Chill" for 30 days.

The court documents outline exactly what must be stated in both apologies.

Mo’s apology must include, “... I apologise unreservedly to Rosie Motene for the pain and suffering my statements caused, including the defamatory insults and the rape and death threats sent from my fans.”

MacG and Phenduka’s apology must say, “We hereby apologise for broadcasting the defamatory statements made by Mr Mahlangu regarding Rosie Motene ...

“We further apologise to our fans for the false statements and will strive to verify content for our shows before broadcasting any content in future.”

Simon Delaney of Delaney Attorneys said that pleadings had closed and all parties were gathering evidence before the matter goes to trial.

Bala Duma, the CEO of “Podcast and Chill”, confirmed that they had been served papers by Motene.

“Those papers are sitting with our lawyers, I can't comment on that matter,” he said in an online report.
